Terms & Conditions

By using our services, you, hereby referenced as “Client” agree to the following terms and conditions:

1. Copyright and Ownership of Photos: All photographs/media produced by Nicholas Emilio Photography are the property of Nicholas Emilio Photography. All delivered photographs/media are provided with a non-exclusive limited commercial use license which includes all forms of online and print marketing for the purpose of promoting the sale of the property. Photographs/media may not be redistributed or resold to other parties (i.e. Property Owners, Designers, Stagers, Architects, Builders, other Real Estate Agents, etc.) by the Client. For additional ongoing usage for Short and Long Term Rentals, additional sales or ongoing commercial use, please contact us for pricing and additional licensing.

2. Payment Terms: We do not require payment up front when placing an order. Payment is due upon initial delivery of ordered media.

3. Incorrect Information: Client acknowledges that if incorrect information is provided during the booking process (i.e. inaccurate square footage) it may result in the final cost being adjusted to a different figure than the initial quote.

4. Cancellation Policy: We understand that sometimes rescheduling is needed. If you need to cancel a scheduled photography session, please let us know in writing as soon as possible. Cancellations with more than 48 hours notice have no charge. Cancellations less than 48 hours but greater than 24 will have a $75 rebooking fee. Cancellations with less than 24 hours will be billed 50% of the scheduled services. Onsite cancellations (including listing not being ready or lack of access) will be billed at 100% of the scheduled services plus any possible travel fees.

5. Delivery: All photographs, video, media are delivered in a digital format through our preferred system. Photographs are delivered the next business day unless otherwise stated prior to the appointment. Standard listing and social media reel videos are delivered within 3 business days. The first business day after a Friday appointment is Monday. We do not deliver on Saturday or Sunday.

6. Publications: Publications related to the listing of the property are allowed with attribution. Printed publications must include photo credit to “Nicholas Emilio Photography”. Digital publications must include a photo credit with a backlink to our website www.nicholasemiliophoto.com while social media publications will include a tag on the photo and a tagged mention in the post to our account on that platform @nicholasemiliophoto. Mailers and flyers do not count as publications and do not require attribution.

7. Copyright Infringement: If we receive notice that any of our photographs, video, produced media have been used without permission or in violation of our terms, we reserve the right to take legal action to protect our copyright.

8. Matterport: Matterport tours will be hosted for 4 months from the date of capture unless otherwise agreed upon. Extended hosting is available at an additional cost. If tours need to be hosted for more than 4 months, it is the client's responsibility to notify us before the tour is disabled. To reactivate a tour after it has been disabled the client will need to pay a reactivation fee in addition to paying for the hosting extension.

9. Aerial/Drone Photography: Client understands that we will to the best of our ability fulfill all drone requests while abiding by all FAA Part 107 and local rules and regulations. Some areas require more than 72 hours notice to request a drone flight through FAA channels. We reserve the right to reschedule drone services for scenarios or weather we deem to be unsafe for the flight.

10. Style Requests: Client has provided in writing by email at least 24 hours prior to the appointment any specific requests regarding the shoot such as photographing certain areas (i.e. inside closets, garages) or capturing specific angles.  If no requests are mentioned we will photograph the listing based on our expertise and typical approach. 

11. Listing Preparation: Client has read our guide to preparing your home for photos and video, and checked and staged everything before the appointment.  This includes details like pillow placement, decor, and other items.  We may adjust some elements if we feel it enhances the image but we assume the space is fully prepared as you want it.
